Use of Website 
By using the California Ballet School (“CBS”) website, you hereby agree to be bound by all of the terms and conditions contained in this User Agreement (“Agreement”). If you do not accept these terms, do not use this website. CBS reserves the right at its discretion to change the terms of this Agreement and will notify users of any such changes by online postings. Your continued use of the CBS website after the posting of any notice of change in terms shall constitute your acceptance to be bound by any such changes.

Limitations on Use
Copyright and Restrictions. All information displayed, transmitted or carried on the CBS website (including, but not limited to, directories, guides, news articles, opinions, text, photographs, images, illustrations, audio clips, video clips, servicemarks and the like, collectively the “Content”) is protected by copyright and other intellectual property laws. The Content is owned by CBS. You may not modify, publish, transmit, transfer, sell, reproduce, create derivative work from, distribute, repost, perform, display, or in any way commercially exploit any of the Content or infringe upon trademarks or servicemarks contained in such Content. You agree to abide by all copyright notices and restrictions attached to any Content accessed through the CBS website, not to alter the Content in any way, and not to alter or remove any trademark, copyright or any other notice from copies of the Content.

Permitted Use. You may make a single copy of the Content displayed on the CBS website for personal, noncommercial use only, provided that you do not remove any trademarks, copyright and any other notice contained in such Content. You shall not archive or retain any Content in any form without the written permission from CBS. You may not distribute (including via email or the Internet), or otherwise make available, copies to others, whether or not for payment or other consideration, without the written permission from CBS.

Changes in this Website. CBS may modify, suspend, discontinue or restrict the use of any portion of the CBS website, including the availability of any Content feature, at any time and without notice or liability.

The CBS website contains facts, views, opinions, statements and recommendations of third party individuals and organizations. CBS does not represent or endorse the accuracy, currentness or reliability of any advice, opinion, statement or other information displayed, uploaded or distributed through the CBS website. Any cause of action with respect to this Agreement and your rights and obligations must be filed in the County of San Diego, State of California within one year after the cause of action, otherwise the cause shall be barred.


California Ballet School Website Children’s Online Privacy Protection Act (COPPA) Compliance Statement

California Ballet School (hereafter referred to as “CBS”) is committed to fully complying with the Children’s Online Privacy Protection Act (COPPA) of 1998. According to which, it is necessary for us to obtain parental permission for all children under the age of 13 to register as a member, or sign up for email newsletters. We will not knowingly accept any information by any children under the age of 13. For any children under the age of 13, a parent or legal guardian must provide consent for any portion of the site which gathers personal information.

Our information practices are fully explained below as required by the Federal Trade Commission#146;s Children#146;s Online Privacy Protection Regulations. In addition, please read our general Privacy Policy.

1. Information Collected (16 CFR 312.4)

General Collection Information
System Logging. Our webserver and e-mail systems keep log files about network transactions. We analyze our these log files to calculate statistics on which pages are visited and how long visitors stay on our site. We do not track individuals with this information. We are required to retain this information for the security of our website and online service. E-mail addresses of messages sent from our system are logged as well. These logs are not viewed unless necessary for security reasons and are deleted after 30 days (16 CFR 312.5(c)(5)(i)).

Internet Addresses. CBS gathers Internet Protocol (“IP”) addresses and pages viewed as part of the logging system within our webserver. When calculating statistics on visits and pages viewed IP addresses are used in broad calculations. IP addresses are never used to identify someone personally unless a security breach requires such an investigation (16 CFR 312.5(c)(5)(i)).

Email Lists and Surveys
Occasionally, people may wish to join email distribution lists. When registering, data is collected to enable us to send messages about CBS, upcoming events, shows, summer camps, and classes. Information requested may include the user#146;s name, email address, instructor#146;s name and email address, school name, and/or zip code of the school.

Dates of birth may be collected to let us know that the right age groups like our site. We also require the birthday so that we may comply with the requirements of the Children#146;s On-line Privacy Protection Act. The date added to the list is collected indirectly. If your child subsequently is removed from the list, we use this information to determine how long a child enjoys our e-mail messages. We do not disclose this information to third parties.

2. Visitor and Member Surveys (16 CFR 312.4)

Occasionally we collect surveys of visitors and CBS members. Any personal information is supplied either optionally or anonymously. Personal information supplied is not saved. And lastly, data is not supplied to, or shared with, any third party.

3. How Data Collected is Used (16 CFR 312.4)
Visitor data is used for system logging, as explained above (16 CFR 312.5(c)(5)(i)), and for calculating statistics, also as explained above (16 CFR 312.5(c)(5)(i)).

4. Third Party Disclosure (16 CFR 312.4)
CBS does not disclose information to third parties. Nor will we ever sell, trade, or release this information with any third party. We will, however, fully comply with any legal information request related to a criminal investigation by the authorities.

5. Participation (16 CFR 312.4)
CBS does not prohibit the participation in any activity based on requiring more personal information than is necessary.

6. Review or Deletion of Privacy Data (16 CFR 312.4)
CBS will make a child#146;s information available for review by the child#146;s parent. Any parent wishing to review or have deleted personally identifiable information about their child should contact our Site Representative.
